ROCKFORD
MANUFACTURING, LTD. - (also referred to as Manufacturer) is a corporation
that engineers, drafts and manufactures steel building systems and components,
which are available through independent, authorized Rockford Steel Buildings
Dealers.
ROCKFORD DEALER ACCEPTANCE CORPORATION
- (also doing business as Rockford Steel Buildings) is a wholly separate
entity from Rockford Manufacturing, Ltd. that provides in-house, Dealer
service representatives to assist Dealers in marketing and selling products
available to them as authorized, independent Rockford Steel Buildings
Dealers. Rockford Steel Buildings is an independent company that is not
an agent, representative, employee or subsidiary of Rockford Manufacturing,
Ltd. or any other manufacturer.
SUNWARD TRUCKING, INC. - is an independent
trucking company with both contract and common carrier authority.
ROCKFORD STEEL BUILDINGS, LTD. DEALER
- (also referred to as Dealer) is an independent, authorized businessperson
that purchases unassembled building components made available through
Rockford Steel Buildings and others. Such Dealers are neither agents,
contractors, representatives nor employees of Rockford Steel Buildings
or Rockford Manufacturing, Ltd. All customers have the responsibility
to investigate and ensure that said Dealer has the skills and qualifications
necessary to meet their needs on a given project and to perform in a workmanlike
manner.
The Dealer and the customer are solely responsible for ordering a structure
that complies with applicable live loads, wind loads, and building code
requirements, and owner must verify these requirements with the local
building official. Manufacturer’s engineer certification is per
the Dealer purchase order as confirmed by the Manufacturer.
Upon request, Rockford Steel Buildings may supply the names of (1) potential
vendors that supply additional components, or
(2) contractors which install concrete, erect the building components
or perform other work pertaining to the installation and erection of the
building components. Rockford Steel Buildings has not investigated such
vendors or contractors. Such provision of names does not
constitute any type of recommendation of their skill or competence. All
customers must rely solely on their own investigation when selecting a
vendor or contractor. Customers must also compare vendors and contractors
so that they are completely satisfied with the price, quality and timeliness
of the job. Rockford Steel Buildings, the Manufacturer, or other affiliates
are not, nor will be involved in construction, nor are they responsible
for any representation or agreement between Dealer or Contractor and Buyer
concerning delivery, construction, modification or other items that are
between the parties thereto.
Metal components are not machine precision manufactured. Some field cutting,
drilling or welding may be necessary for construction.
The construction company, erector, dealer and owner are responsible for
(1) carrying adequate insurance for all risks of loss, damage or injury
before, during and after construction; (2) for hiring sub-contractors
that carry adequate insurance, including worker’s compensation insurance;
and (3) for naming Manufacturer as an additional insured under the above-referenced
insurance policies and indemnifying and holding Manufacturer harmless
from any loss, damage or injury, whether to person or property, which
may occur before, during or after construction. All of the above-referenced
parties understand that Manufacturer does not enter the construction site
and does not provide any person or entity with instruction in construction
methods, material moving techniques or site preparation or safety, nor
does it supply tools or equipment for same.
Erection of these buildings, as all construction, can be very dangerous.
Contractor, Dealer and Owner are responsible for all safety procedures,
and should follow all applicable rules and regulations as well as standard
industry safety procedures, and are responsible for selecting workmen
and subcontractors with the experience necessary to complete the construction
in a safe and workmanlike manner.
